These Terms of Service ("Terms") govern your use of the Kich application ("Kich," "the app," "we," "our") operated by Alamo Consulting Group. By creating an account or using Kich, you agree to these Terms.
You must be at least 13 years of age to use Kich. By using the app, you represent that you meet this requirement. If you are under 18, you must have permission from a parent or legal guardian.
You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep your login credentials confidential. You must notify us promptly if you become aware of any unauthorized use of your account.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Kich for personal, non-commercial purposes, subject to these Terms.
You retain ownership of all content you create, upload, or save in Kich, including recipes, photos, notes, and other materials ("Your Content"). By using Kich, you grant us a limited license to store, display, process, and transmit Your Content solely for the purpose of providing and operating the app's features. We do not claim ownership of Your Content.
You are responsible for ensuring that Your Content does not violate any applicable laws or infringe on the rights of others.
Kich allows you to create and participate in shared cookbooks with other users. When you add content to a shared cookbook, other members of that cookbook can view and interact with that content. The cookbook creator has administrative control over the cookbook, including the ability to manage members and content. You are responsible for the content you contribute to shared cookbooks.
You agree not to use Kich to upload, store, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable. You agree not to attempt to gain unauthorized access to any part of the app, other users' accounts, or our systems. You may not use Kich for unauthorized commercial exploitation, resale, or distribution of the app or its services.
You are responsible for ensuring that Your Content does not infringe the intellectual property rights of others. By uploading or sharing content in Kich, you represent that you have the necessary rights or permissions to do so.
If you believe that content within Kich infringes your copyright, you may submit a written notice to support@kich.app including your contact information, a description of the copyrighted work, and the location of the allegedly infringing material. We will review and take appropriate action, including removal of content where required.
We reserve the right to remove content that we reasonably believe violates intellectual property rights.
Kich is a tool for personal recipe management. Users are solely responsible for ensuring their use of the app complies with applicable intellectual property laws.
Kich uses automated systems to process content you upload, such as extracting text from images of recipes. These features are provided as-is and may not always produce perfectly accurate results. You are responsible for reviewing and verifying any automatically processed content.
We strive to keep Kich available and functioning, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the app at any time without prior notice. We are not liable for any loss of data or interruption of service. Users are responsible for maintaining their own backup copies of important content.
Kich offers a free tier and a paid subscription ("Kich Pro"). Kich Pro is available as the following subscriptions:
Kich Pro Monthly — $4.99 per month
Kich Pro Annual — $39.99 per year
Payment will be charged to your account at confirmation of purchase. Prices may change with reasonable notice.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through the platform where you subscribed.
All payments are processed by third-party providers. Refunds are handled by the provider through which you subscribed.
If your subscription ends, your existing content remains yours. You will not lose access to anything you have already saved.
You may delete your account at any time through the app settings. Account deletion follows a 30-day grace period as described in our Data Deletion Policy. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
Kich is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Alamo Consulting Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of recipes, or interruption of service.
We are not responsible for failure to perform due to causes beyond our reasonable control, including but not limited to internet outages, hosting failures, natural disasters, or actions of third-party service providers.
You agree to indemnify and hold harmless Alamo Consulting Group and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of Kich, your violation of these Terms, or your violation of any rights of another person or entity.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the app. Your continued use of Kich after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
